These Terms and Conditions ("Terms") are issued by TrueBlueReview.com.au ("TrueBlueReview", "we", "us", "our").
We operate the website https://TrueBlueReview.com.au (the "Site") and provide services including review-request automation and reputation-support tools (together, the "Services").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.
The Services are intended for users aged 18 years or over.
TrueBlueReview provides tools and services to help businesses request and manage customer feedback (including Google reviews). This may include:
Important: We do not control what customers write, whether they leave a review, or what rating they give.
1.1 The Services are provided for business use and are not intended for distribution or use in any jurisdiction where such use would be unlawful.
1.2 You acknowledge that TrueBlueReview's role is to facilitate sending review requests and related communications on your behalf, based on your configuration and data.
2.1 You must be at least 18 years old to use the Services.
2.2 You may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
2.3 You must provide accurate and current information and promptly update it if it changes.
3.1 You are responsible for consent. You warrant that you have obtained all required consents and permissions to provide customer contact details to us and to send review requests to those customers.
3.2 Compliance with Australian laws. You agree to comply with all applicable laws and regulations, including (without limitation):
3.3 Accuracy of data. You are responsible for the accuracy, quality and legality of all data you upload or provide, including customer phone numbers and email addresses.
3.4 No unlawful or misleading conduct. You must not use the Services to send misleading, harassing, defamatory, unlawful, or non-consented communications.
3.5 Your customer relationship. You are responsible for your customer experience and any customer complaints relating to your business, your request practices, and your communications.
4.1 Fees are as set out on the Site or in your order form (if applicable). Unless stated otherwise, prices are in Australian dollars (AUD).
4.2 If GST applies, we may add GST to the price in accordance with Australian tax law.
4.3 You authorise us (or our payment processor) to charge your nominated payment method for fees, including recurring subscription fees.
4.4 We may correct pricing errors and may change pricing prospectively. If your subscription price changes, we will provide reasonable notice where required.
5.1 Auto-renewal. Subscriptions renew automatically unless cancelled before the end of the current billing period.
5.2 Cancellation. You can cancel your subscription using your account settings (if available) or by contacting us. Cancellation takes effect at the end of your current paid period unless we agree otherwise in writing.
5.3 No refunds are provided for partial periods unless required by law (including Australian Consumer Law).

7.1 Authorisation. By using the Services, you authorise TrueBlueReview to send SMS and/or email messages to your customers on your behalf, using the sender details and content you configure (including any default templates you accept).
7.2 Spam compliance. You must ensure messages comply with the Spam Act, including (where required):
7.3 Opt-outs. Where the platform supports opt-out handling (e.g., "STOP" replies or email unsubscribe links), we will use reasonable efforts to process opt-outs. You remain responsible for ensuring opt-outs are respected across your systems and that opted-out contacts are not re-uploaded or re-messaged.
7.4 Content responsibility. You are responsible for message content (including any custom text). You must not use messages to mislead customers or offer prohibited incentives in a way that breaches platform rules (see section 8).
8.1 The Services may integrate with or link to third-party platforms (including Google Business Profile and Google review links).
8.2 No affiliation. TrueBlueReview is not endorsed by, affiliated with, or sponsored by Google (unless explicitly stated in writing by us).
8.3 Platform rules. You are responsible for complying with third-party platform policies, including Google's policies (for example, around review solicitation, incentives, and prohibited "review gating" practices). If a platform restricts or changes functionality, it may affect the Services, and we are not responsible for those third-party changes.
9.1 We own (or license) all intellectual property in the Services, Site, software, templates, branding, and related materials.
9.2 We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your internal business purposes during your subscription term.
9.3 You must not reproduce, resell, or exploit our materials except as permitted by these Terms or with our written consent.
10.1 You may provide content such as business names, branding, message templates, and customer data ("Client Content"). You grant us the right to use Client Content solely to provide the Services.
10.2 If you provide feedback or suggestions, you grant us the right to use them without restriction or compensation.
11.1 We handle personal information in accordance with our Privacy Policy (if published on the Site). If there is any inconsistency between these Terms and the Privacy Policy, the Privacy Policy governs personal information handling.
11.2 You acknowledge that you may be disclosing personal information (your customers' contact details) to us for the purpose of sending review requests. You warrant you have provided any required notices and obtained any required consents.
11.3 Data retention and deletion (if applicable) will be managed in accordance with our Privacy Policy and legal requirements. You may request deletion of your account data, subject to lawful retention obligations.
12.1 We use reasonable measures to protect the Services, but no system is completely secure.
12.2 We may perform maintenance or updates which can cause downtime. We do not guarantee uninterrupted availability.
13.1 No guarantee of reviews or results. We do not guarantee the number, timing, rating, sentiment, or content of reviews.
13.2 Customer choice. Customers choose whether to leave a review and what to write.
13.3 Delivery limitations. SMS/email delivery can be affected by carriers, spam filters, device settings, and third-party outages.

14.2 On termination, your right to use the Services ends immediately. We may disable access to your account and data, subject to legal retention obligations.
To the maximum extent permitted by law, the Services are provided "as is" and "as available." We do not warrant that the Services will be error-free, uninterrupted, or meet your specific requirements.
16.1 Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law (ACL).
16.2 Exclusion of indirect loss. To the maximum extent permitted by law, we are not liable for any indirect, special, incidental, consequential, or exemplary loss, including loss of profits, loss of revenue, loss of goodwill, or loss of data arising from or related to your use of the Services.
16.3 Liability cap. To the maximum extent permitted by law, our total liability arising out of or in connection with the Services is limited (at our option) to:
(a) resupplying the Services; or
(b) paying the cost of having the Services supplied again;
and in any event will not exceed the total fees paid by you to us in the 1 month prior to the event giving rise to the claim.
You agree to indemnify and hold harmless TrueBlueReview and our officers, employees, contractors, and agents against any claim, loss, liability, cost, or expense (including reasonable legal costs) arising from:
18.1 If a dispute arises, the parties agree to first attempt to resolve it in good faith via informal discussions.
18.2 If unresolved, either party may refer the dispute to mediation in Queensland, Australia, unless the parties agree otherwise.
18.3 Nothing in this section prevents either party from seeking urgent injunctive or equitable relief.
We may update these Terms from time to time by posting the updated version on the Site and changing the "Last updated" date. Your continued use of the Services after updates are posted means you accept the updated Terms.
